Encumbrance- An outstanding legal claim against a property by a party other than its owner.  Such claims can include liens, restrictive covenants and easement rights.  The existence of an encumbrance against a property is typically revealed as the result of a title search. An encumbrance may limit a property owner's ability to transfer title to another party or diminish the property's value.
